GENEVE (28 aout 2013) – « La Côte d’Ivoire a franchi une étape significative vers le processus de reconstruction démocratique, la consolidation de l’Etat de droit, et la promotion de la réconciliation nationale », a déclaré aujourd’hui Doudou Diène, Expert indépendant sur la situation des droits de l’homme en Côte d’Ivoire, saluant l’adoption, le 26 août des lois sur la nationalité et sur le foncier par l’Assemblée Nationale.
« La manipulation politique et l’ethnicisation ont fait de ces problèmes de véritables bombes à retardement, dont les déflagrations ont nourri une culture de violence, érodé les valeurs et traditions de vivre ensemble et déstructuré ce pays région, de forte et ancienne immigration », a noté Monsieur Diène.
«La loi sur la nationalité a redressé un facteur récurrent d’instabilité et d’affaiblissement de la de la société ivoirienne en tenant compte des engagements internationaux de la Côte d’Ivoire relatifs à l’apatridie et aux droits de l’homme », a-t-il déclaré. La loi sur la propriété foncière promeut la cohésion intercommunautaire et la prospérité économique commune en restaurant le droit et la justice comme socle fondamental de la société ivoirienne ».
Dans ses précédents rapports, l’Expert avait indiqué que ces deux questions centrales sont au cœur de la longue crise qui a profondément bouleversé la société Ivoirienne. Il avait demandé aux autorités de prendre des mesures de redressement pour empêcher que l’instrumentalisation politique de ces problèmes ne vienne aggraver des conflits au sein de la société ivoirienne.
« Avec l’adoption de ces deux lois, une dynamique forte de réconciliation nationale est ainsi en construction, balisée par la libération provisoire de détenus de l’ancien régime », a noté Monsieur Diène. Cette dynamique doit être consolidée et rendue irréversible par la relance forte du dialogue politique et la promotion décisive d’un pluralisme démocratique inclusif », a-t-il souligné tout en espérant que les autorités ivoiriennes prendront les dispositions nécessaires pour mettre en œuvre ces lois.
« J’appelle la communauté internationale à accompagner et à consolider ce processus, notamment en confortant sa base économique et sociale par des investissements significatifs », a déclaré l’Expert Indépendant.

Côte D’Ivoire: “Adoption of laws on nationality and land tenure, major step towards reconciliation,” says UN expert
GENEVA (29 August 2013) – “Côte d’Ivoire has made a significant step forward in the democratic reconstruction process, the consolidation of the rule of law, and the promotion of national reconciliation,” today said the United Nations Independent Expert on the situation of human rights in Côte d’Ivoire, Doudou Diène, hailing the adoption on 26 August of the laws on nationality and on land tenure by the National Assembly.
“Political manipulation and ethnicization have made of these issues a time bomb, feeding a culture of violence, eroding values and traditions to live together, and affecting the structure of this ‘region-country’ with a strong and old immigration tradition,” Mr. Diène noted.
“The law on nationality has redressed a recurrent factor of instability and weakening of the Ivorian society by embracing Côte d’Ivoire’s international commitments on statelessness and human rights,” he said. “The law on land tenure promotes intercommunity cohesion and joint economic prosperity by restoring law and justice as fundamental bedrock of the Ivorian society.”
In his previous reports, the Independent Expert has stressed that these two key issues are at the heart of the long crisis that has deeply affected the Ivorian society. He urged the authorities to take appropriate measures to prevent the political manipulation of both issues from worsening current conflicts in the Ivorian society.
“With the adoption of these two laws, a strong dynamic of national reconciliation is underway, reinforced by the release of detainees close to the former regime,” Mr Diène noted. “Such dynamics should be consolidated and made irreversible by the re-launching of the political dialogue and the decisive promotion of an inclusive democratic pluralism,” he stressed while hoping that the Ivorian authorities will take the necessary measures to implement these laws.
“I call on the international community to accompany and to consolidate the process, including by reinforcing its economic and social basis by significant investments in Côte d’Ivoire,” the UN Independent Expert said.
